Terms of Service

These Terms of Service (“Terms”) govern your use of MyGallery3D. By creating an account or using the service, you agree to these Terms. If you don’t agree, please don’t use the service.
The service
MyGallery3D lets you turn products from your online store, or images you upload yourself, into a walkable 3D gallery that you can share by link and that visitors can explore on a phone, a computer, or a VR headset. Features may change over time as we improve the product.
Your account
You’re responsible for the activity under your account and for keeping access to your sign-in email secure. You must provide accurate information and be at least 13 years old to use MyGallery3D.
Your content and rights
You keep all ownership of the content you import or create: your images, product information, captions, and galleries (“Your Content”). We don’t claim ownership of your work.
You grant us a limited, non-exclusive, royalty-free license to host, store, process, and display Your Content for the purpose of operating the service and showing your gallery to the people you share it with.
This license ends when you delete Your Content or your gallery. Two practical exceptions: copies may remain in routine backups for a reasonable period before they age out, and anything that has already been shared, quoted, or copied by other people is outside our control.
You represent that you own or have the necessary rights to all content you import or upload, including any images, artwork, and text, and that displaying it through MyGallery3D doesn’t infringe anyone else’s rights.
Being listed in Explore
When you publish a gallery, we ask whether you’d like it listed in Explore, our public directory. That choice is yours, it’s made at publish, and you can change it at any time in your gallery’s Settings.
If your gallery is listed, you also permit us to show its cover image, title, and a link to it in Explore and on our homepage, and to feature it in our own promotion, including on social media and in advertising for MyGallery3D. We will always link back to your gallery.
If you unlist your gallery, we stop doing both of those things going forward. We can’t retract promotional posts that have already gone out, so if you’d rather we never featured a gallery at all, leave it unlisted from the start.
Being unlisted is not the same as being private. A published gallery is a public web page: it works for anyone who has the link, it can be shared and embedded, and search engines can find and index it. Unlisting removes it from our directory and our promotion, not from the internet. If a gallery shouldn’t be public at all, don’t publish it.
Acceptable use
You agree not to:
- Upload or display content that is unlawful, infringing, or violates anyone’s rights.
- Use the service to harass, deceive, or harm others.
- Attempt to disrupt, reverse-engineer, or gain unauthorized access to the service or its infrastructure.
- Use the service in any way that violates the terms of a connected platform (such as Shopify or Etsy).
Our intellectual property
The MyGallery3D name, logo, software, designs, and the overall look and feel of the service are owned by us and protected by intellectual property laws. These Terms don’t give you any right to use our branding or copy our software, except to use the service as intended.
Payments, subscriptions, and refunds
Building and editing galleries is free. You only pay when you make a gallery public (“go live”). Paid plans are billed per gallery based on its size, and an optional PRO add-on applies to your whole account.
Payments are processed by our payment provider, Lemon Squeezy, who acts as the merchant of record. Starting a paid plan also means you accept their terms.
Where a free trial is offered, your plan begins with that trial and you are not charged until it ends. After that, plans renew automatically (monthly or yearly) until you cancel. You can cancel anytime from your dashboard and keep access until the end of the period you’ve already paid for.
Prices may change, and we’ll give notice before a change affects you. Except where the law requires otherwise, payments are non-refundable, but if something goes wrong, contact us and we’ll try to make it right.
Third-party platforms
MyGallery3D connects to third-party platforms. To build a gallery from a store or portfolio we read from Shopify, Etsy, Squarespace, Wix, and WooCommerce; to import your own images you can connect Google Drive or Dropbox. Your use of those platforms is governed by their own terms and policies, and we’re not responsible for them. Connecting an account means you authorize us to access only the data needed (for Google Drive and Dropbox, only the files you pick), as described in our Privacy Policy.
Copyright and takedowns
We respect intellectual property rights and expect you to do the same. If you believe content in a gallery infringes your copyright, email contact@mygallery3d.com with a description of the work, the gallery link, and your contact details. We’ll review and remove infringing content where appropriate, and we may suspend accounts that repeatedly infringe.
Service availability
We work to keep MyGallery3D available and reliable, but we provide the service “as is” and “as available,” without warranties of any kind. We may modify, suspend, or discontinue features at any time.
Limitation of liability
To the maximum extent permitted by law, MyGallery3D will not be liable for any indirect, incidental, or consequential damages, or for any loss of data, revenue, or profits, arising from your use of the service.
Indemnification
To the extent permitted by law, you agree to cover us for reasonable claims, losses, and costs that arise from content you import or upload, your use of the service, or your breach of these Terms.
Termination
You can stop using MyGallery3D and delete your account at any time (see the Privacy Policy for how to delete your data). We may suspend or terminate accounts that violate these Terms or that we reasonably believe create risk for us or others.
Governing law and disputes
These Terms are governed by the laws of the country in which MyGallery3D operates, without regard to its conflict-of-law rules. If a dispute arises, please contact us first so we can try to resolve it directly before taking any other step.
Changes to these terms
We may update these Terms from time to time. When we do, we’ll revise the “Last updated” date above. Continuing to use the service after changes take effect means you accept the updated Terms.
